LABOR RIGHTS OF WORKING MOTHERS

On Mother’s Day, we want to inform you that the Federal Labor Law provides for several rights for working mothers, which are as follows:

 

  • If the mother is pregnant, she will not be required to perform work that involves considerable efforts and poses a risk to her health in relation to the pregnancy.
 
  • Mothers will enjoy a six-week rest period prior to and six weeks after giving birth, receiving their full salary.
 
  • If the children are born with any type of disability or require hospital medical attention, the rest period may be extended up to eight weeks after giving birth, upon presentation of the corresponding medical certificate.
 
  • Similarly, in the case of adoption of an infant, the mother will be entitled to six weeks’ paid leave following the day the infant is received.
 
  • During the breastfeeding period, for a maximum term of six months, working mothers will have two extraordinary breaks per day, of half an hour each, to feed their children in a suitable and hygienic place designated by the company, or when this is not possible, the employer must agree to reduce their working day by one hour during the indicated period.
 
  • Working mothers may return to the position they held before pregnancy, provided that no more than one year has elapsed since the date of delivery, and the pre and postnatal periods must be included in their seniority; they will also be considered active employees for the payment of profits
