DEADLINE FOR REGISTRATION AND PROCESSING OF PROCEDURES FOR LEGITIMIZATION OF EXISTING COLLECTIVE LABOR AGREEMENTS

On March 6, 2023, the “Agreement on the deadline for registration and resolution of the legitimization procedures for existing collective labor contracts” was published in the Official Gazette of the Federation.

The Agreement specifies that, pursuant to the Eleventh Transitory Article of the Decree reforming, adding and repealing various provisions of the Federal Labor Law, and others on labor justice, labor union and collective bargaining, published in the Official Gazette of the Federation on May 1, 2019, the deadline for the registration of Collective Labor Contracts is May 1, 2023. Additionally, the deadline for the resolution of inquiries related to the legitimization procedures for existing collective labor contracts is July 31 of the same year.

In light of the foregoing, we must urge you to register the legitimization processes on the platform of the Federal Center for Conciliation and Labor Registration before May 1, 2023. The only thing determined by the Agreement we are referring to is the deadline for the execution of these processes, which expires on July 31, 2023.

We believe that the clarification regarding the deadline for the execution of the legitimization processes addresses the large number of registered Collective Labor Contracts that have not been legitimized, as well as the lack of infrastructure to process the large number of requests that will likely be entered on the platform during the remainder of March and April of this year.

Therefore, if your company has entered into a Collective Labor Contract that has not yet been legitimized, we suggest that you urge your union representatives to register the request as soon as possible on the platform of the Federal Center for Conciliation and Labor Registration and to carry out the process as soon as possible, otherwise there would be a risk of losing it.
