THE SENATE APPROVES THAT COMPANIES MUST HAVE AT LEAST 5% OF OLDER ADULTS IN THEIR WORKFORCE.

On March 14, 2023, the Senate of the Republic approved the amendment of Articles 132 and 133 of the Federal Labor Law, establishing that employers are prohibited from refusing to hire elderly people.

Among the most important points, it was established that the workforce of companies must be made up of at least 5% elderly workers when they have 20 or more employees.

Furthermore, employers are obligated to implement the necessary actions and programs to promote employment and paid work for the elderly, in order to enable their hiring according to their trade, profession or skill without further restriction than their physical or mental limitation declared by the corresponding authority.

The amendment to the aforementioned articles was sent to the Chamber of Deputies and, if approved, will be forwarded to the Executive Power for publication in the Official Gazette of the Federation (DOF) and entry into force.
